Terms of Service
These terms explain how CREDA works and what you can expect from us. They are written in plain language but are legally binding. If anything is unclear, contact us before you rely on CREDA for important decisions.
CREDA is software. It is not a bank, SACCO, microfinance institution, or regulated financial services provider. Your group and its officials remain responsible for how money is collected, approved, and disbursed.
1. The service
CREDA provides an online platform for groups (such as chamas, savings groups, and similar entities) to record and view information about members, contributions, loans, penalties, meetings, and related workflows. Features may change over time as we improve the product.
We host the software and make it available on a subscription or agreed basis. Unless we explicitly agree otherwise in writing, we do not hold your members' cash on our balance sheet, operate payment accounts for you, or guarantee investment returns.
2. Who you are
You may use CREDA as an individual member, group officer, or organisation user. You must be at least 18 years old (or the age of majority where you live) and able to enter a binding contract.
If you create or administer a group on CREDA, you confirm that you have authority to do so on behalf of that group or organisation, and that the group's rules and any applicable law allow the use of a platform like CREDA.
3. Your responsibilities
You agree to:
- Provide accurate information and keep your account details (especially phone and email) up to date.
- Use CREDA only for lawful purposes and only for operations you are authorised to perform within your group.
- Keep login credentials and devices secure, and tell us promptly if you suspect unauthorised access.
- Respect controls built into the product (for example, maker–checker rules where a person cannot approve their own entries).
- Not attempt to disrupt the service, scrape it in a way that harms others, or reverse engineer it except where the law allows.
Group officials are responsible for configuring permissions sensibly, supervising members, and making decisions that affect money — not CREDA.
4. Data and privacy
We process personal data to run CREDA, as described in our Privacy Policy. By using the service, you acknowledge that group-related data may be visible to other members and authorised administrators according to your group's settings and roles.
You are responsible for the accuracy of data you enter and for obtaining any consents or notices your group may need under the Kenya Data Protection Act, 2019 or other law.
5. Subscriptions and billing
Access to some features may require an active subscription, trial, or separate agreement. Fees, billing cycles, and payment methods are shown in the product or in your order form.
- Unless stated otherwise, fees are exclusive of taxes and third-party charges (for example mobile money or bank fees).
- We may suspend or limit features if payment is overdue, after reasonable notice where practicable.
- Cancellation and refund rules follow what we display at checkout or in your contract; statutory rights are not excluded where they cannot be excluded by law.
6. Third parties
CREDA may integrate with payment providers (for example M-Pesa), messaging providers, hosting providers, and identity or analytics tools. Those services have their own terms. We are not responsible for outages or acts of third parties outside our reasonable control.
7. Intellectual property
CREDA, its branding, and the software are owned by us or our licensors. We grant you a limited, non-exclusive licence to use the service for your internal group purposes in line with these terms. You retain ownership of data you upload; you give us permission to host and process it to provide the service.
8. Acceptable use and suspension
We may suspend or terminate access if we reasonably believe there is fraud, abuse, a security risk, or a breach of these terms. Where appropriate, we will try to notify you and give you a chance to fix the issue, unless immediate action is needed to protect users or the platform.
9. Disclaimers
The service is provided "as is" and "as available". We work hard to keep CREDA reliable and secure, but we do not guarantee uninterrupted or error-free operation. Calculations and reports depend on data entered by users; you should verify critical figures before acting on them.
10. Limitation of liability
To the fullest extent permitted by the laws of Kenya, CREDA and its team are not liable for indirect, consequential, or punitive loss, or for loss of profit, goodwill, or data, arising from your use of the service.
Our total aggregate liability for any claim relating to the service in a twelve-month period is limited to the amount you paid us for CREDA in that period (or, if none, a reasonable nominal amount). Nothing in these terms limits liability that cannot legally be limited, including for death or personal injury caused by negligence, fraud, or other liability that Kenyan law does not allow to be excluded.
11. Indemnity
You will defend and hold harmless CREDA and its personnel against claims brought by third parties that arise from your misuse of the service, your breach of these terms, or your group's activities, except to the extent caused by our wilful misconduct.
12. Changes
We may update these terms from time to time. We will post the new version on this page and update the "Last updated" date. If a change is material, we will try to give you reasonable notice (for example by email or in-app). Continued use after the effective date means you accept the updated terms.
13. Dispute resolution and governing law
These terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law rules.
If a dispute arises, we ask that you contact us first so we can try to resolve it in good faith. If it cannot be resolved within a reasonable period, you agree that the courts of Kenya have exclusive jurisdiction, unless mandatory law gives you a right to bring proceedings elsewhere.
